State Says; The Brain Is More Dangerous, Direct Involvement Is Not Necessary!
Jail gate is not opening. Prof. GN Saibaba and four of his co-prisoners will be remaining inside the prison cells for indefinite period.
Today at the Supreme Court, Bench of Justice Mihir Shah and Justice Bela M Trivedy suspended the Bombay High Court’s order discharging five of them in alleged Maoist links case. So no relief for them until next hearing, as the SC found “a fault with the High Court for not entering the merits of the case and for finding a short cut to decide (on the basis of sanction).”
We would not like to go into Courtroom nitty-gritties; rather mention just a single point over here. The same judiciary which delays months after months merely to start a trial for in case of Bhima-Koregaon prisoners, with such a haste they could make a move to allow an Apex Court even on a Saturday to resist the discharge of five political prisoners, whose freedom is already overdue.
While Senior Advocate R Basant, appearing for Saibaba, submitted that the State has accused Saibaba of being the ‘mastermind’, and argued that there is nothing to show his involvement– Justice Mihir Shah orally remarked, “So far as terrorist or Maoist activities are concerned, the brain is more dangerous. Direct involvement is not necessary.”
